Welcome to Pixflux.AI!

These Terms of Use ("Terms") are an agreement between you ("User", "you" or "your") and Pixflux Team ("we", "us", or "our") governing your access to and use of our services, website (pixflux.ai), API, software, and all related tools and features (collectively, the "Platform" or "Services"). By accessing or using any part of the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

1. Acceptance and Changes

1.1. By accessing or using the Platform, you accept these Terms, our Privacy Policy, and any other guidelines we may publish (collectively, the "Agreement"). We may update or amend these Terms from time to time. Please check this page regularly for the most current version. Continued use of the Platform constitutes your acceptance of any changes.

1.2. We may, at our discretion, modify, suspend, or discontinue the Platform or any part thereof at any time, without notice or liability.

2. User Eligibility & Account

2.1. You must be at least 18 years old to use the Platform. If you are under 18, you may only use the Platform under the supervision of a parent or legal guardian, who agrees to be bound by these Terms.

2.2. You may use some features of the Platform without registration. Some advanced features may require you to create an account, provide accurate and up-to-date information, and maintain the confidentiality of your credentials. You are responsible for all activities occurring under your account.

2.3. Notify us immediately of any unauthorized use of your account or security breach. We are not liable for any loss or damage resulting from your failure to safeguard your account.

3. Use of Services & User Conduct

3.1. You may use the Platform only for lawful purposes and in accordance with these Terms. You must not:

  • Attempt to access, probe, or test the vulnerability of the Platform or circumvent any security measures
  • Use the Platform in any way that could damage, disable, impair, or compromise our systems or security
  • Upload, transmit, or distribute any malicious software, viruses, or harmful code
  • Infringe upon the rights (including copyright, trademark, privacy, or publicity) of any person or entity
  • Upload or process any content for which you do not have the necessary rights and permissions
  • Use the Platform to store or share any unlawful, harmful, abusive, defamatory, or otherwise objectionable content
  • Violate any applicable law or regulation

3.2. You affirm that you own or have the necessary licenses for all content you upload or process on the Platform.

4. Content and Intellectual Property

4.1. Your Content. You retain all rights in any content (including images, text, files, etc.) you upload, create, or process through the Platform. You grant Pixflux Team a worldwide, non-exclusive, royalty-free, sublicensable license to use, process, display, reproduce, modify, and distribute your content as necessary for operating and improving the Platform. This includes, for example, enabling image processing and storage, and maintaining service functionality.

4.2. Ownership and Copyright. All intellectual property and content on the Platform, other than User content, is owned by Pixflux Team or its licensors. You may not reproduce, distribute, modify, or create derivative works from any part of the Platform without our explicit written consent.

4.3. Feedback. Any feedback, comments, or suggestions you provide may be used by Pixflux Team without restriction or compensation to you.

4.4. We reserve the right (but are not obligated) to remove or restrict any content that we determine violates these Terms, the law, or our policies.

5. Payments, Subscriptions, and Refunds

5.1. Fees for paid Services are disclosed before purchase and are subject to change. All fees are payable in advance and are non-refundable unless expressly stated otherwise.

5.2. You are responsible for providing and maintaining valid payment information. Failure to pay any fees may result in suspension or termination of your access to the Platform.

5.3. Pixflux Team reserves the right to change pricing, introduce new charges, or change the features of free or paid plans at any time, with notice via the Platform or email.

5.4. All purchases are final and non-refundable unless otherwise required by applicable law.

6. API Acceptable Use

6.1. Use of the Pixflux.AI API is subject to fair and reasonable use. Excessive or abusive API requests may result in throttling, suspension, or termination of API access.

6.2. You may not attempt to reverse-engineer, decompile, or otherwise derive the source code of the API.

6.3. We may monitor and audit API usage for compliance.

7. Disclaimers and Limitation of Liability

7.1. The Platform and Services are provided "as is" and "as available," without warranties of any kind, either express or implied.

7.2. We do not guarantee the Platform will be uninterrupted, error-free, secure, or meet your expectations.

7.3. To the fullest extent permitted by law, Pixflux Team and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, profits, or business arising out of or related to your use or inability to use the Platform.

7.4. In any event, Pixflux Team's total liability to you for all claims arising from or related to the Platform will not exceed the amount paid by you (if any) in the 12 months preceding the claim.

8. Termination

8.1. Pixflux Team may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately.

8.2. You may delete your account at any time by contacting us at service@pixflux.ai. Upon deletion, we will use reasonable efforts to remove your data, subject to our legal obligations.

9. Privacy and Data Protection

9.1. Your use of the Platform is also governed by our Privacy Policy, which is available at pixflux.ai/privacy.

10. Indemnification

10.1. You agree to indemnify and hold harmless Pixflux Team, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to your violation of these Terms, your content, or your use of the Platform.

11. Miscellaneous

11.1. Severability: If any provision of these Terms is found invalid or unenforceable, the remainder will continue in full force and effect.

11.2. Waiver: Any waiver must be in writing and signed by Pixflux Team. Failure to enforce any provision does not constitute a waiver.

11.3. Assignment: We may transfer our rights and obligations under these Terms to another entity at our discretion.

11.4. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Pixflux Team operates, without regard to conflict of law principles. You consent to the exclusive jurisdiction of the courts located in Pixflux Team's principal place of business.
